The Metropolitan Police said the allegations related to incidents reported to have taken place between 1997 and 2000, involving a boy under the age of 16.

An investigation began in December 2016 after a referral from another police force. As part of the inquiry, a man in his 40s at the time understood to be Mills was interviewed under caution in July 2018. Police submitted a full file of evidence to the Crown Prosecution Service (CPS). However, prosecutors determined that the evidential threshold required to bring charges had not been met. As a result, the case was formally closed in May 2019 with no further action taken. The Metropolitan Police confirmed that the alleged victim was under 16 years old at the time of the reported incidents. The details of the investigation emerged publicly following Mills’ recent departure from the BBC, where he had been hosting the Radio 2 Breakfast Show. The BBC said only that he was no longer contracted to work for the organisation and declined to comment further on the circumstances. Mills has not been charged with any criminal offence in relation to the allegations.
