Court Restrains NBC From Sanctioning Broadcasters Over Opinions, Neutrality A Federal High Court sitting in Lagos has restrained the National Broadcasting Commission NBC from sanctioning broadcast stations and presenters over issues relating to on-air opinions, neutrality, and treatment of guests pending further hearing of a lawsuit challenging the regulator’s directive. The interim order was granted by Justice Daniel Osiagor following an ex parte application filed by the Socio-Economic Rights and Accountability Project SERAP alongside the Nigerian Guild of Editors NGE. In his ruling, the judge barred the NBC from enforcing its recently issued “Formal Notice,” which had warned broadcasters against presenting opinions as facts, intimidating guests during programmes, or failing to maintain neutrality on air. The court directed the commission to suspend any planned sanctions, threats, or punitive actions against television and radio stations pending the determination of the substantive suit. The applicants argued that the directive represented an arbitrary and unlawful attempt to regulate editorial judgment and restrict freedom of expression within Nigeria’s broadcast industry. The lawsuit followed widespread concern among media stakeholders after the NBC circulated guidelines cautioning presenters and broadcast organisations about perceived bias and professionalism on live programmes. SERAP and the NGE contended that the regulator’s notice could be used to silence journalists, suppress critical opinions, and undermine constitutional guarantees of press freedom. Their counsel, Adeyinka Olumide-Fusika SAN, urged the court to protect broadcasters from what he described as regulatory overreach. Media observers say the court’s intervention temporarily shields broadcasters from penalties while the legality of the NBC directive is examined. The ruling reinforces ongoing debates about the balance between professional broadcasting standards and freedom of expression in Nigeria’s democratic space. The court adjourned the matter for further proceedings, during which arguments from both parties will be fully heard before a final decision is delivered. Until then, the NBC is restrained from imposing sanctions connected to the disputed guidelines.
