El-Rufai’s defence counsel to file no-case submission as DSS closes prosecution The defence counsel to former Kaduna State Governor, Nasir El-Rufai, Paul Erokoro SAN, has indicated plans to file a no-case submission, arguing that the prosecution has failed to establish sufficient evidence against his client in the ongoing alleged wiretapping trial. The development followed the closure of the prosecution’s case by the Department of State Services DSS at the Federal High Court in Abuja. According to proceedings, the prosecution informed the court that it would not be calling further witnesses, effectively ending its case in the matter. Following this, the defence team signalled its intention to challenge the sufficiency of the evidence presented. Erokoro argued that the prosecution had not established a prima facie case strong enough to require the former governor to enter a defence, prompting the planned no-case submission. The defence subsequently sought additional time from the court to formally file the application, while the prosecution also requested time to respond to the motion. The court has adjourned the matter to allow both parties file and respond to the legal submissions, continuing proceedings in the high-profile case involving allegations of unlawful interception of communications.

The DSS case against El-Rufai forms part of an ongoing trial in which he is accused of alleged breaches of national security laws. He has consistently denied wrongdoing.
