The case forms part of renewed legal efforts by a non-governmental organisation, the Break the Silence Foundation, which is pushing for a fresh and more comprehensive investigation into the circumstances surrounding the singer’s death, which continues to generate public controversy nearly three years after the incident. According to court proceedings, the suit marked FHC/ABJ/CS/363/2026 was filed against the Inspector-General of Police, the Nigeria Police Force, and the Commissioner of Police, Lagos State Command. The foundation is seeking a judicial review and an order of mandamus compelling the police to revisit earlier findings and pursue additional leads it believes were not adequately investigated. Justice James Omotosho, who is presiding over the matter, had earlier granted leave for the suit to proceed and adjourned the matter for hearing before subsequently fixing a date for judgment. The case adds another layer to the long-running legal and public dispute over Mohbad’s death, which has already passed through multiple stages of investigation, including a coroner’s inquest and police inquiries. Mohbad, who died on September 12, 2023, at the age of 27, was initially buried shortly after his death but was later exhumed for an autopsy amid growing public outrage and allegations of foul play. However, the autopsy process did not provide a definitive cause of death due to the state of decomposition at the time of examination. The unresolved nature of the case has continued to fuel public debate, social media campaigns, and legal actions demanding justice and clarity. While some investigations have pointed toward medical negligence, others have called for deeper scrutiny into the circumstances leading to his death.

The controversy has also delayed the singer’s final reburial, as disagreements and legal proceedings continue to surround the case. Despite previous rulings and recommendations from investigative bodies, including a coroner’s court, stakeholders and supporters of the late singer have continued to push for a more definitive conclusion. The judgment scheduled for September 29 is expected to determine whether authorities will be compelled to reopen the investigation or maintain the existing findings.
